Tutor Jolly User Agreement&Privacy Policy



This Privacy Policy ("Policy") describes how PopSand Robotics Company Limited and its related companies ("we" or "us" or the "Company") collect, use and share the Tutor Jolly mobile application ("Tutor Jolly" or "Apps") App"), this website (the "Site") and other services provided by the Company (the App, the Website, and such services shall be collectively referred to as the "Services"). This policy also applies to any other mobile application or website that posts this policy. This policy does not apply to websites that post a different statement.

1. What we collect

We obtain information about you in a variety of ways:

1.1. Information you provide to us. We collect information that you provide us directly, such as voice recordings of your interactions with our Smart Tutors through the App (“Voice Recordings”), as well as your name, email address, phone number, passwords, social networking accounts login credentials and demographic information. Please note that we only record voice recordings when you interact with our smart tutor through the app - we do not have access to your device's microphone at any other time.

1.2. Aggregated data. "Aggregated Data" is what we collect about a group or class of functions, services or individuals, where Personal Information is removed from the scope of collection. For example, information about how you use a feature may be collected and combined with information about how others use the same feature to create data that does not contain any personal information.

1.3. Information we receive from others. We may obtain information about you from other sources. We may add this to the information we receive from the Service. We allow you to access third-party services, such as Facebook and Twitter, to import information about who you connect with on those other services so that you can connect with them on the Services. Some of these third-party services may also provide us with information from your account to enhance and personalize your use of the services; you can modify your privacy settings directly using these other services.

1.4. Information Collected Automatically. We automatically record information about you and your computer. For example, when you visit Tutor Jolly, we record your computer operating system type, browser type, browser language, pages you view, time you spend on the page, access time, Internet Protocol (IP) Address and information about your use and operation on Tutor Jolly. We also collect (a) information stored on your phone, such as Advertiser ID, phone make and model, and default language, (b) your login information (via email or Facebook), and (c) your approximate location (via IP address).

1.5. Policy. We may use "cookies" to record information only to improve our services. Cookies are small data files that a website stores on your hard drive. Cookies help us make our services and your visit better. We use cookies to see which parts of our services people use and like, and to count visits to our services.

1.6. Public Content. You can contribute to the Service in a number of different ways that other users can view, including writing reviews, uploading videos and photos, participating in forums, tagging products, filling out your public profile, and voting on other users' contributions. We may store these contributions (your "Public Content"), display them to other users, and use them for promotional purposes. 2.6. To monitor and analyze usage and trends, and to personalize and improve Tutor Jolly and your experience while using Tutor Jolly.

2.7. Respond to comments and questions and provide customer service.

2.8. To send communications, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.

2.9. To protect, investigate and prevent fraudulent, unauthorized or illegal activities.

2.10. To communicate promotions, upcoming events and other news about products and services offered by us and our selected partners. Our legal basis for processing your personal information is (a) we have your consent to process your personal information for the above purposes, and (b) such processing is necessary for us to provide our services. We retain your personal information in order to provide services to you and as necessary to comply with our legal obligations, resolve disputes and enforce our agreements; otherwise, we will delete your personal information immediately upon termination of your account.

3. Sharing personal information

In some cases, we may share your personal information with third parties without notice, except as required by law as follows:

3.1. With your friends on Tutor Jolly according to the preferences set in your account.

3.2. Cooperate with companies that may provide you with products and services. You can opt out of this sharing by contacting us through the channels listed in "Contact Information" below.

3.3. For some social networking services, if you allow such sharing through our services.

3.4. Obtaining your consent. For example, you may allow us to share personal information with third parties for their own marketing purposes. These uses will be governed by such third party's privacy policy.

3.5. With those who provide Tutor Jolly services, such as sending Tutor Jolly email communications, analyzing usage logs and recordings to improve our Smart Tutors, and administering Tutor Jolly marketing campaigns.

3.6. Research in cooperation with educational institutions and other third parties.

3.7. We may sell or license voice recordings to third parties that have been stripped of information that could directly identify you (such as your name and contact information).

We may share Aggregated Data with interested third parties to assist them in conducting research, developing new products, and understanding interest in certain information, products, services, data, content, services, advertising, promotions, and/or features on the Services and usage patterns.

4. Retention of personal information

We will retain your personal information for as long as your account is active and as reasonably necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

5. Your Privacy Rights and Choices

You have certain rights and may make certain choices regarding our processing of your personal information:

5.1.You can ask us to restrict the processing of your personal information or object to our processing of your personal information by contacting us, in which case you will no longer have an account with Tutor Jolly.

5.2. You can withdraw our agreement at any time by deleting your account.

5.3. You are under no obligation to provide any personal information, but (a) we will not be able to communicate with you if you do not provide an email address, and (b) we will not be able to provide you with information about your Pronunciation feedback.

5.4. Our marketing emails tell you how to "opt out". If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your account and our business dealings with you.

5.5. You may send requests for personal information to us at the contact information below. You can request changes to your contact choices, opt-out of our sharing with others, and update your personal information.

5.6. You can delete and reject cookies from our services using your browser settings. Many browsers are preset to accept cookies until you change your settings. If you delete or reject our cookies, it may affect the services we provide to you.

6. Information collected during the process of providing you with goods or services

6.1. Sharing and publishing of personal information: When you use Tutor Jolly, upload and/or publish personal information and study, we will collect the personal information you upload, publish or form, and have the right to display your nickname and published content .

6.2. Product purchase: In order for you to purchase and enjoy course services in Tutor Jolly, you may need to provide us with contact information (name, phone number), address information (for example, if you need to mail teaching materials, handouts and other learning materials) service), transaction serial number information (used to verify whether the purchase line is completed), invoice issuance information (if you need it), and remark information so that we can provide you with the purchase service of specific course products. If you refuse to provide such personal information, we will not be able to complete the relevant delivery services.

6.3. Payment: When you make payment on our platform, you can choose Tutor Jolly to see the payment services provided by the cooperative third-party payment institutions. We will use your account, order, transaction, payment, and delivery information related to the progress of the transaction through your selected transaction partner, payment institution, logistics company, etc., or share your transaction information with the above-mentioned service providers. The payment function itself does not collect your personal information, but we need to share your order information with the aforementioned payment institutions to confirm your payment instructions.

6.4. Order management: In order to display the order information of your account and protect your after-sales rights and interests, we will collect your order information, transaction and consumption records, and virtual property information during use for display to you and for your convenience. Orders are managed.

6.5. Customer service: When you contact our customer service, our system may record the communication records between you and customer service for identity verification; when you need us to provide customer service related to your order, we may Query your relevant order information so as to give you appropriate help and handling; when you need customer service to assist you in modifying relevant information (address, contact information), you may also need to provide other supporting information other than the above information to complete the modification.

7.Register, Membership, and Use of TutorJolly

7.1.Registration, Membership, and Subscription

7.2.You can register on the TutorJolly app. To register, you will be asked to enter your email and set a password.

7.3.You may be asked to select a payment method and provide relevant payment details. You may need to pay through the website or app at the same time as you create your registration.

7.4.Any registration without payment information is considered a registered membership of TutorJolly.

7.5.Any registration involving payment or authorized payment information is considered a VIP membership of TutorJolly.

7.6.To distinguish, we refer to registrations without payment information as "registration" and registrations with payment information as "VIP membership".

8.Information You Provide and Accept Orders

8.1.By registering or ordering a VIP membership, you confirm that you are at least 18 years of age and able to enter into binding contracts. You also confirm that all information you provide to us is complete and accurate.

8.2.We will accept your order when you place an order on our website and arrive at the confirmation or welcome page after payment is initiated, at which point a contract will be entered into between you and us regarding these Terms relating to your registration and membership. If we are unable or decide not to accept your order, we will notify you by email and you will not be charged (and will refund any payment you have received). For example, this could be because our payment processor is not properly handling the payment method you have chosen.

9.How registration and membership work

9.1."Registration" includes creating an account on the TutorJolly app and may or may not include membership. Depending on your geographic location, the timing of registration, and personal arrangements between TutorJolly and you, registration may or may not involve paid or free access to any of our products and services for a limited period.

9.2.The "VIP Membership" constitutes a paid membership to our digital service TutorJolly, a subscription-based e-learning platform.

9.3.All memberships to our digital service, TutorJolly, are "digital" in nature.

9.4.VIP membership does not include delivery or provision of physical products.

10.VIP membership options and payments

10.1.Your VIP membership subscription can be monthly, quarterly, or annually. You can select the relevant membership option when placing your order. In each case, your membership will continue until the relevant subscription period and will automatically renew for another subscription at the end of that subscription unless you cancel. You will be required to pay the applicable VIP membership fee before each subscription period (see section titled "Pricing and Payments" below).

10.2.Some VIP memberships include a "trial membership" in which payments are authorized but not made until the trial period ends.

10.3.Canceling (or starting to cancel) a trial or VIP membership is the user's job, not the company's job. See "Cancellation" below for details on cancellation.

11.Account Security

You must keep your login and password confidential and are responsible for their security. We may disable or suspend your membership if we believe that your account has been accessed by a third party or used outside of compliance with these Terms. If you know or suspect that anyone other than you know your login details or has accessed your account, please contact us via customerservices@tutorjolly.com.

12.Pricing

12.1.The price of the VIP membership will be announced on our TutorJolly app and will vary depending on whether your membership is paid monthly, quarterly, or annually. Before placing an order, you should check if the price reflects your affiliate choice.

12.2.Pricing may vary based on geographic location or membership purchase time. The Company does not guarantee that historical pricing will be matched, respected, or reflected at all times, nor that pricing in other jurisdictions will be guaranteed.

13.Process payments

13.1.If you sign up for TutorJolly's VIP membership at the beginning of your membership, or if it's a trial membership, you'll get the first payment when your trial membership expires.

13.2.If you have purchased a VIP membership or trial membership on a platform other than our app, you should look for payment information on the above platforms, with Apple and Google's app stores being the most prominent.

13.3.Payment made when you place an order is made through our appointed payment processing service provider PayPal (Europe) S.A.R.L. ET Cie, S.C.A. ("PayPal"), Billwerk GmbH ("Billwerk"), Stripe Inc., GoCardless Ltd. or Heidelpay Payment GmbH ("Heidelpay"). You can pay with most major debit or credit cards, especially any Visa or Mastercard. We do not receive your credit or debit card information as this is processed by our payment processing service provider. It is also possible to pay through the App Store or Play Store platforms of Apple and Google.

13.4.We reserve the right to reject any transaction or reverse any transaction by our payment processing service provider (for example, to prevent money laundering or fraud). If we do not receive your payment for this or any other reason, then your order will not be accepted or, where applicable, your VIP membership will not be renewed.

13.5.(Where PayPal is used) PayPal terms for providing payment processing services, which govern your use of PayPal accounts, how funds are forwarded to you, any applicable processing fees, and other important issues, are outlined in your contract with PayPal by the standard terms of PayPal. We are not responsible for the performance of PayPal or any dispute between you and PayPal.

13.6.While membership options may be listed in GBP or EUR, you can pay in any currency. The conversion rate of the app will be determined by our appointed payment processing service provider.

13.7.Unless otherwise specified in the list, all prices are inclusive of VAT. At the time of payment, it is not necessarily indicated to you whether you paid VAT or not, and if so, how much VAT was paid, but we will show this information as much as possible.

14.Cancellation

14.1.Your Consumer Rights.

14.2.Under the UK Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013 (the "Regulations") and equivalent local laws in many European countries, consumers have certain rights to cancel contracts entered into remotely. The membership contract between you and us is one such contract and you have the right to cancel the contract within fourteen (14) days from the date of the contract, which is the date we accept your membership order (the "Cancellation Period"). For example, if we accept your order on March 1, you can cancel at any time before the end of March 15. As our services are subscription-based, they will be provided to you immediately after the conclusion of the contract and during the cancellation period. Any "trial" period given is included in the cancellation period.

14.3.How to cancel during cancellation.

14.4.We strive to make it easier for members to cancel. The member's cancellation option can be found in the account settings within the app.

14.5.Refunds in case of cancellation during the cancellation period.

14.6.Upon request, we will issue a refund without delay within the cancellation period and no later than fourteen (14) days after you notify us of the date of cancellation. We will issue refunds using the same payment method as the initial transaction and you will not be charged any additional fees for reimbursement.

15. Terms and Conditions of Use

15.1. You agree to abide by the following User Policy. If you do not agree to any of the following terms and conditions, please stop accessing the Platform immediately.

15.2. The membership account provided by the platform is for your personal use only. You may not register or use multiple accounts, or otherwise make your accounts available to third parties for a fee or without charge.

15.3. You should keep your account properly and protect the security of your account. In case of any error or identity fraud, you should notify the platform as soon as possible, and strive to provide relevant information for the platform to investigate

15.4. You shall ensure the accuracy and completeness of the personal information provided to us for registration purposes and shall update it as required by the Platform.

15.5. You should review all notices provided by the Platform. You should regularly check all announcements on the platform regarding website service processes and policies; you should visit the platform regularly.

15.6. You shall be responsible for the electronic equipment, devices, Internet access for receiving or delivering the Course and its functional services through the Platform and shall ensure its availability. If you are unable to participate due to technical errors or failures not attributable to the platform, the platform will not be liable for any costs and/or losses; you have no right to request a refund of such course function service fees and membership fees.

15.7. You may not alter, delete or destroy platform data or equipment by robots or otherwise. You may not exploit vulnerabilities, if any, embedded in the platform's design, bypass security measures to alter, delete or collect data on the platform, or use technologies that may affect the operation of the platform.

15.8. You may not abuse any rewards, coupons, obtain illegal benefits for yourself or others, or otherwise use marketing and reward policies not expressly permitted by the Platform.

15.9. In the event of a dispute arising from a payment or refund, you should endeavor to cooperate with the platform, provide relevant information for investigation, and cooperate with banks, financial institutions or other relevant authorities to complete the investigation process.

15.10. You shall not solicit or lure any User, or encourage them to leave or cease using the Platform, or attempt to do so.

15.11. You shall maintain the function and operation of teaching evaluation. You may not use a robot or otherwise influence Tutor Jolly's assessment, or influence another person's Tutor Jolly assessment by benefit, threat, intimidation or otherwise.

15.12. You may not use the Platform for false or illegal transactions.

15.13. You shall not infringe the rights of the platform or users, including infringing the copyrights, trademarks, patents, trade secrets and other intellectual property rights of others.

15.14. You are not allowed to publicly upload information, send private information, post comments or conduct such behaviors through the platform, which involve obscenity, defamation, defamation, inaccuracy, abusive, illegal or other behaviors that may make others feel uncomfortable. You may not harass or send other users non-Course-related messages.

15.15. You may not harass, harm, threaten or stalk other members of the Platform by words or actions.

15.16. You may not, on the basis of race, social class, language, ideology, religion, political opinion, ancestry, place of birth, gender, sexual orientation, age, marriage, appearance, facial features, physical and mental disability, horoscope, blood type, etc., pass Words or actions to discriminate against members of the platform.

15.17. Without the written consent of the platform, you may not promote for-profit or non-profit advertisements for yourself or on behalf of others through the platform.

15.18. According to the principle of good faith, you shall be bound by the terms and conditions stipulated in the platform service agreement, and shall abide by the applicable local laws and regulations of your jurisdiction, and shall not engage in any improper behavior that may damage the platform, users or third parties .

15.19. The platform will continue to implement an effective and sound review mechanism to review all content you submit, publish, upload, transmit, share, link, display or otherwise provide (collectively referred to as "publishing"), including but not limited to Comments, news, opinions, graphics, images, audio, video, questions and other user-generated content (collectively referred to as "User Content"), to ensure that the generated content complies with the Tutor Jolly User Service Agreement and the platform when publishing any user content You represent, warrant and agree that:

15.19.1. Posted User Content shall not contain any unlawful, pornographic, violent, terrorist, threatening, bullying, defamatory, hateful, racially discriminatory, harassing, tortious, unlawful, immoral or otherwise objectionable material that violates the intellectual property rights of any party Content. If any of the above-mentioned conditions are found in the platform members or user content, they should immediately report or report to the customer service center of the platform, and the platform will strictly deal with it.

15.19.2. You may not use false email addresses, impersonate any person or entity, or otherwise mislead Users with Content.

15.19.3. When posting any User Content, you represent and warrant that: (i) you are the sole owner of the User Content; (ii) the User Content is accurate; (iii) you are at least thirteen (13) years of age; and (iv) Submitted User Content does not violate any or all policies of the Platform.

15.19.4. You must ensure that any user content you publish complies with applicable laws, regulations and relevant regulations. In the event of any infringement or illegality, you shall be solely responsible for all resulting liability.

15.19.5. You grant the Platform and related entities a perpetual, unrestricted, non-exclusive, fully sublicensable, irrevocable and worldwide license to use, modify, adapt, publish, translate, create derivative works in any media anywhere in the world Composition, distribution and display of User Content. 15.19.7. If the user content you publish violates the Tutor Jolly User Service Agreement and other policy requirements of the platform, or if the platform believes that the user content may cause objections for any reason, the platform reserves the right to delete any user content on the platform without reason, The right to suspend or terminate your account without liability for any inconvenience or financial loss caused to you.

16. Advertising and Remarketing

16.1. We may allow other companies (known as third-party ad servers or ad networks) to serve advertisements on the Site or within the App. These third-party ad servers or ad networks use technology to deliver advertisements and links displayed on the Site directly to your browser. When this happens, they automatically receive your IP address. They may also use other technologies (such as cookies, JavaScript or web beacons) to measure the effectiveness of their advertisements and to personalize the content of their advertisements. We do not knowingly collect personally identifiable information from any minor without parental consent. Anyone who provides personal information to us through this website represents that they are over 18 years old or the minor's parents have given consent. We request and store a user's date of birth, but we do not share that information unless the user chooses to share user information on his profile. 23. Other

23.1. The Platform is operated and supported by PopSand Robotics Company Limited, a Hong Kong company with registered address at Unit 510-511, 5/F, Grand City Plaza, 1 Sai Lau Kok Road, Tsuen Wan, N.T.

23.2. The Terms of Service constitute the entire agreement between you and the Platform in relation to the use of the Platform.

23.3. If the platform fails to exercise any rights under the service agreement, it shall not be deemed as the platform waiving the rights. If certain terms and conditions under the Service Agreement are declared invalid or unenforceable by court judgment, the remaining terms shall remain valid and enforceable.

23.4. You agree that the email you use to register on the Platform shall be considered as your means of communicating with the Platform.

23.5. If you have any questions about the service agreement, please contact the customer service of the platform. The platform may refuse to process such inquiries if such inquiries do not comply with the formalities.

23.6. The Service Agreement and Terms of Service shall be governed by the laws of the Hong Kong Special Administrative Region. The Platform and Members agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
